Terms of Service

1. Acceptance of these terms

These Terms of Service (the "Terms") are an agreement between you and ScentSpin ("ScentSpin", "we", "us"), operated from San Francisco, California. They cover the ScentSpin website, dashboard, waitlist and any related services (together, the "Service").

By joining the waitlist, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Eligibility

You must be at least 18 years old to use ScentSpin. The Service is a tool for buying goods on other marketplaces, and those marketplaces require adult accounts. By using the Service you confirm that you are 18 or older and legally able to enter into this agreement.

3. What ScentSpin does

ScentSpin is a deal finder for fragrance collectors. On a schedule, it:

• reads public listings from third-party marketplaces and auction sites, with more sources added over time;
• compares each listing's price with what the item typically sells for, using public price history, realized auction prices and our own rules;
• sends listing photos and titles to an AI vision model (Anthropic's Claude) to identify bottles, estimate fill level and flag likely problems;
• shows you the results and links you to the original listing on the marketplace.

What ScentSpin does not do: we do not sell fragrances, hold inventory, place bids, take payment for items, ship anything, or act as a party to any purchase. Every transaction happens on the marketplace, between you and the seller, under that marketplace's terms.

The Service is currently a private beta. Features may change, break or disappear while we build it.

4. Accounts and the waitlist

Waitlist. You can request access by giving us your email address and, optionally, a few details about how you buy. We use that only to contact you about ScentSpin access and product updates, as described in the Privacy Policy.

Beta access. During the beta, access is granted by invitation and protected by a shared sign-in. Keep your sign-in credentials private, don't share them with anyone else, and tell us right away if you think they've been exposed. You're responsible for everything done through your access.

Accuracy. Give us accurate information and keep it current. We can refuse or revoke access at our discretion, especially during the beta.

5. Acceptable use

ScentSpin is meant to be used by a person, through the interface we provide, for their own buying decisions. You agree not to:

• scrape, crawl, or bulk-download the Service or its data, or access it with automated tools, bots or scripts other than an ordinary web browser;
• resell, sublicense, share or otherwise redistribute access to the Service, its deal feed or its data to anyone else, including by republishing our scores or alerts;
• circumvent or attempt to circumvent access controls, rate limits, plan limits or any usage restriction;
• reverse-engineer the Service or use it to build a competing product;
• use the Service to break any marketplace's terms, to harass sellers, to commit fraud, or for any unlawful purpose;
• interfere with the Service or place an unreasonable load on it.

If you break these rules we may suspend or terminate your access without notice.

6. Third-party marketplaces and affiliate links

Marketplaces. Listings shown in ScentSpin belong to the marketplaces and sellers who posted them. When you click through, you leave ScentSpin and are bound by that marketplace's terms, policies and fees. We have no control over listings, sellers, prices, availability, shipping, returns or disputes, and we're not responsible for any of them. Comply with each marketplace's rules; if your marketplace account is limited or closed, that's between you and the marketplace.

Affiliate disclosure. Listing links in ScentSpin go through our own redirect and may be affiliate (partner) links. If you click one and make a purchase, we may earn a commission from the marketplace through its partner program. This does not change the price you pay, does not affect how we score or rank listings, and applies to free and paid accounts alike. We record that a link was opened so we can measure the Service; see the Privacy Policy.

Trademarks. Fragrance house and marketplace names are the trademarks of their respective owners. ScentSpin is not affiliated with, endorsed by or sponsored by any of them.

7. Free browsing and paid plans

Free browsing ("Browse"). Anyone can browse the finds without an account. The free feed is deliberately delayed: finds appear there about two hours after our scanner surfaces them (the exact delay is shown on the plan page and may change). Listing links open normally. Saved finds on the free plan are stored in your browser only, up to five at a time, and are not synced or backed up.

Plans. We offer the following paid plans. The plan page shows current prices and limits; where it differs from this section, the plan page wins.

• Collector (monthly or yearly): the feed without the delay, unlimited saved finds tied to your account, a daily email digest, up to three watches with email alerts, and price-drop alerts on saved finds.
• Pro (monthly or yearly): everything in Collector, unlimited watches, faster alert delivery (including Telegram where offered), estate-lot bottle tables, the seller-feedback filter, data export, first access to new categories and priority support.
• Founder (one payment, limited to 50 seats): Pro-level access for 24 months from purchase, then Collector-level access for the life of the Service at no further charge. Founder seats are personal, cannot be transferred or resold, and end if your access is terminated under section 10. "For the life of the Service" means for as long as ScentSpin is operated; if we discontinue the Service we owe you nothing further for the Founder seat beyond what section 9 provides.

Limits. Watches, alerts, saves and similar features have plan limits; we may enforce them automatically and may adjust them with notice. Alerts and the digest are sent by email on a best-effort basis; delivery times are targets, not guarantees, and depend on your email provider.

• Billing. Subscription fees are billed in advance for each billing period (monthly or yearly) and renew automatically until you cancel. Founder seats are billed once and do not renew.
• Cancelling. You can cancel a subscription at any time from the billing page or by email. Your access continues until the end of the period you've already paid for, then drops to free browsing. Your saved finds stay in your account for 90 days after that.
• Refunds. We don't refund partial periods or unused time, except where the law requires it. If you bought a Founder seat, you can ask for a full refund within 14 days of purchase as long as you have not opened more than 20 listings through it.
• Price changes. We'll give you at least 30 days' notice by email before a subscription price change takes effect. If you don't want to pay the new price, cancel before it starts. Founder seats are never re-priced after purchase.
• Payments. Payments are handled by a third-party payment processor under its own terms. We don't see or store your full card number.
• Taxes. Prices exclude any applicable sales tax or VAT, which will be added where required.

8. Disclaimers

Estimates are estimates. Every price, typical-price estimate, discount figure, fill-level reading, condition or authenticity flag and "deal" label in ScentSpin is an automated estimate built from public data, our scoring rules and an AI model's reading of listing photos. Any of them can be wrong, stale or based on a misdescribed listing. They are not appraisals, financial advice or a promise of any outcome.

Verify before you buy. Listings may be counterfeit, mislabeled, damaged, partially used, or described inaccurately by the seller, and the AI may misread them. You are solely responsible for inspecting a listing, judging authenticity, asking the seller questions and deciding whether to bid or buy. Any loss from a purchase is yours.

As is. The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We don't warrant that any listing will still be available, that any listing will turn out to be a good deal, or that the Service will meet your needs.

9. Limitation of liability

To the fullest extent permitted by law, ScentSpin and its owner will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost revenue, lost data or purchase losses, arising out of or related to the Service or any listing it displays, even if we've been told such damages are possible.

Our total liability to you for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50.

Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that can't be limited by law.

10. Termination

You can stop using the Service at any time, and can ask us to delete your data as described in the Privacy Policy. We may suspend or end your access at any time, with or without notice, if you break these Terms, if we're required to by law, or if we discontinue the Service. Sections 6, 8, 9, 12 and any other terms that by their nature should survive will survive termination.

11. Changes to these terms

We may update these Terms as the product grows. When we make a material change we'll update the effective date above and, if you're on the waitlist or have an account, let you know by email or a notice in the app. Continuing to use the Service after a change takes effect means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute that can't be resolved informally will be brought in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction. Before filing anything, please email us; most problems can be sorted out with a conversation.
